Pharmaceutical Companies Attempt to Block Xarelto Lawsuit Consolidation

Xarelto, a blood thinning drug, has come under fire since the drug was blamed for causing some of those taking the drug to bleed to death. Those filing lawsuits against the manufacturers of Xarelto, Johnson & Johnson and Bayer, are seeking to consolidate their cases and present the information before one judge.

Blood Thinner Linked to Deaths

Xarelto was approved in 2011 to benefit patients experiencing blood clots in relation to knee and hip surgeries. It is currently also prescribed to those with irregular heartbeats, and leg and lung clots. It was marketed as effective in preventing strokes and reducing the need to monitor blood-plasma levels. By 2013, the drug made over $2 billion in sales from its use.

According to claims about Xarelto:

  • Was not properly tested before going on the market
  • Hid the information that there was no antidote
  • Overstated the effectiveness

Johnson & Johnson and Bayer have been accused of downplaying the risk Xarelto has on its users. Reports suggest that at least 65 deaths have been associated with the drug and there is no antidote once the bleeding begins. According to Bayer and Johnson & Johnson, all anti-coagulants carry the risk of bleeding and this information is outlined in all prescribing information. They further claim that the benefit-risk profile for Xarelto is consistent with clinical trials they participated in.

Consumers seeking lawsuits against the company have asked to consolidate the cases in order to ease their preparation for the case. Additionally, one large claim means the trial could be presented in front of a single judge and prevent the need for numerous, isolated trials. The drug companies are seeking for the claims to remain separate, and if they are consolidated, to be tried in New Jersey near their corporate offices.
